    1. Scope<\/h2>\n

    1.1<\/strong> This license agreement (hereinafter “Agreement”) is a legally binding agreement between a consumer or a company (hereinafter “Licensee”) and devowl.io GmbH (hereinafter “Licensor”). By installing, copying or using any portion of the purchased product (hereinafter “Software”) licensed under this agreement, you agree to be bound by the terms of this agreement. Unless otherwise agreed, the inclusion of the licensee’s own terms and conditions is hereby rejected.<\/p>\n

    1.2<\/b>\u2009Consumer within the meaning of this agreement is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to his commercial nor his independent professional activity.<\/p>\n

    1.3<\/b>\u2009An company within the meaning of this agreement is a natural or legal person or a partnership with legal capacity, which acts in the exercise of its commercial or independent professional activity when concluding a legal transaction.<\/p>\n

    2. Subject of the contract<\/h2>\n

    2.1<\/strong>\u2009Subject of the contract is the transfer of the software offered by the licensor to the licensee in electronic form under the granting of certain rights of use which are regulated more precisely in this license agreement.<\/p>\n

    2.2<\/strong> This Agreement grants Licensee a non-exclusive, transferable license to use the software in its WordPress website or, in the case of software for making its own products, to design and develop its own software (hereinafter “WordPress Plugin”). The duration of the license is determined by the term of the overall agreement.<\/p>\n

    2.3<\/strong> Parts of the entire software which are not under this agreement may be under other licenses (e.g. the GPL license). By accepting this license agreement, the licensee accepts the different licensing of the parts of the software and knows that the software can only fulfil its function if all other license agreements are also accepted.<\/p>\n

    3. Granting of rights of use<\/h2>\n

    3.1<\/strong> The licensee receives a license for the purpose of using a WordPress plugin at one WordPress website or, in the case of software for making own products, for the development of a WordPress plugin. A WordPress website describes a website as a standalone WordPress installation or a website within a WordPress Multisite installation, but not multiple websites under one domain or subdomain. The License must purchase a separate license for each additional use of the software or, in the case of software for making its own products, for each additional WordPress plugin.<\/p>\n

    3.2<\/strong> The licensee receives the right to use and modify the source code of the software. The licensee is the owner of all original works written by the licensee; the licensor retains all copyrights and other intellectual property rights to the software.<\/p>\n

    3.3<\/strong> The licensee is not permitted to move, remove, edit or obscure copyright, trademark, attribution, warning or disclaimer notices in the software.<\/p>\n

    3.4<\/strong> The regulations explained in 3.3 also apply to parts of the software which are provided under a license other than this agreement.<\/p>\n

    3.5<\/strong> In the event that the software is used to create own products, the licensee may only use the software to create applications that differ substantially from the software (e.g. a fully functional WordPress plugin, but e.g. no own boilerplate for creating WordPress plugins). Users of your WordPress plugins may use the software or your modifications of the software for development purposes.<\/p>\n

      1. Geltungsbereich<\/h2>\n

      1.1<\/strong> Diese Lizenzvereinbarung (nachfolgend “Vereinbarung”) ist eine rechtsverbindliche Vereinbarung zwischen einem Verbraucher oder einem Unternehmer (nachfolgend “Lizenznehmer”) und der devowl.io GmbH (nachfolgend “Lizenzgeber”). Durch die Installation, das Kopieren oder die Verwendung von der unter dieser Vereinbarung lizenzierten Teilen von dem erworbenen Produkt (nachfolgend “Software”) erkl\u00e4ren Sie sich mit den Bedingungen dieser Vereinbarung einverstanden. Hiermit wird der Einbeziehung von eigenen Bedingungen des Lizenznehmers widersprochen, es sei denn, es ist etwas anderes vereinbart.<\/p>\n

      1.2<\/strong>\u2009Verbraucher im Sinne dieser Vereinbarung ist jede nat\u00fcrliche Person, die ein Rechtsgesch\u00e4ft zu Zwecken abschlie\u00dft, die \u00fcberwiegend weder ihrer gewerblichen noch ihrer selbst\u00e4ndigen beruflichen T\u00e4tigkeit zugerechnet werden k\u00f6nnen.<\/p>\n

      1.3<\/strong>\u2009Unternehmer im Sinne dieser Vereinbarung ist eine nat\u00fcrliche oder juristische Person oder eine rechtsf\u00e4hige Personengesellschaft, die bei Abschluss eines Rechtsgesch\u00e4fts in Aus\u00fcbung ihrer gewerblichen oder selbst\u00e4ndigen beruflichen T\u00e4tigkeit handelt.<\/p>\n

      2. Vertragsgegenstand<\/h2>\n

      2.1<\/strong>\u2009Vertragsgegenstand ist die \u00dcberlassung der vom Lizenzgeber angebotenen Software an den Lizenznehmer in elektronischer Form unter Einr\u00e4umung bestimmter, in diesem Lizenzvertrag genauer geregelten, Nutzungsrechte.<\/p>\n

      2.2<\/strong> Diese Vereinbarung gew\u00e4hrt dem Lizenznehmer eine nicht exklusive, \u00fcbertragbare Lizenz zur Nutzung der Software in seiner WordPress Website oder im Falle dessen, dass es sich um eine Software zur Anfertigung von eigenen Produkten handelt, die Gestaltung und Entwicklung von eigener Software (nachfolgend “WordPress-Plugin”). Die Dauer der Lizenz bestimmt sich durch die Vertragslaufzeit des Gesamtvertrags.<\/p>\n

      2.3<\/strong> Teile der gesamten Software, welche nicht unter dieser Vereinbarung stehen, k\u00f6nnen unter anderen Lizenzen stehen (z. B. der GPL-Lizenz). Mit der Annahme dieses Lizenzvertrags nimmt der Lizenznehmer die verschiedene Lizenzierung der Teil der Software wahr und wei\u00df, dass die Software seine Funktion nur erf\u00fcllen kann, wenn alle anderen Lizenzvertr\u00e4gen ebenso zugestimmt wird.<\/p>\n

      3. Einr\u00e4umung von Nutzungsrechten<\/h2>\n

      3.1<\/strong> Der Lizenznehmer erh\u00e4lt eine Lizenz zum Zweck der Nutzung eines WordPress-Plugins auf einer WordPress Website oder im Falle dessen, dass es sich um eine Software zur Anfertigung von eigenen Produkten handelt, Entwicklung von einem WordPress-Plugin. Eine WordPress-Website beschreibt eine Website als eigenst\u00e4ndige WordPress Installation oder eine Website innerhalb einer WordPress Multisite Installation, nicht aber mehrere Websites unter einer Domain oder Subdomain. Der Lizenznehmer muss f\u00fcr jede weitere Nutzung oder im Falle dessen, dass es sich um eine Software zur Anfertigung von eigenen Produkten handelt, zur Erstellung jedes weiteren WordPress-Plugins eine weitere separate Lizenz der Software erwerben.<\/p>\n

      3.2<\/strong> Der Lizenznehmer erh\u00e4lt das Recht, den Quellcode der Software zu verwenden und zu \u00e4ndern. Der Lizenznehmer ist der Eigent\u00fcmer aller Originalarbeiten, die von dem Lizenznehmer verfasst werden; der Lizenzgeber beh\u00e4lt weiterhin alle Urheberrechte und andere geistige Eigentumsrechte an der Software.<\/p>\n

      3.3<\/strong> Es ist dem Lizenznehmer nicht gestattet, Urheberrechts-, Marken-, Zuordnungs-, Warn- oder Haftungsausschlusshinweise in der Software zu verschieben, zu entfernen, zu bearbeiten oder zu verdecken.<\/p>\n

      3.4<\/strong> Die in 3.3 erl\u00e4uterte Vorschriften finden auch auf Teile der Software Anwendung, welche unter einer anderen Lizenz als dieser Vereinbarung bereitgestellt werden.<\/p>\n

      3.5<\/strong> Im Falle dessen, dass es sich um eine Software zur Anfertigung von eigenen Produkten handelt, darf der Lizenznehmer die Software nur zur Erstellung von Anwendungen verwenden, die sich wesentlich von der Software unterscheiden (z. B. ein vollst\u00e4ndig funktionsf\u00e4higen WordPress-Plugin, jedoch z.B. kein eigenes Boilerplate zur Erstellung von WordPress-Plugins). Benutzer Ihrer WordPress-Plugins d\u00fcrfen die Software oder Ihre Modifikationen der Software f\u00fcr Entwicklungszwecke verwenden.<\/p>\n
